West Virginia Left Lane Law

West Virginia requires vehicles traveling slower than the normal speed of traffic to use the right-hand lane available for traffic or stay as close as practicable to the right side of the roadway. Exceptions apply when passing another vehicle or preparing for a left turn.

West Virginia's primary keep-right rule is found in West Virginia Code §17C-7-1.

On roadways of sufficient width, vehicles generally must be driven on the right half of the roadway unless a statutory exception applies.

A vehicle traveling at less than the normal speed of traffic under the existing conditions must be driven in the right-hand lane available for traffic, or as close as practicable to the right-hand curb or edge of the roadway.

The slower-traffic rule does not apply when the driver is overtaking and passing another vehicle traveling in the same direction or when preparing for a left turn at an intersection or into a private road or driveway.

West Virginia also allows official signs to direct slow-moving traffic into a designated lane, and drivers must obey those lane-use signs.

In addition, West Virginia prohibits driving so slowly that the normal and reasonable movement of traffic is impeded unless the reduced speed is necessary for safe operation or required by law.

Exceptions

  • Overtaking and passing another vehicle traveling in the same direction.
  • Preparing for a lawful left turn at an intersection or into a private road or driveway.
  • The right half of the roadway is closed because of construction or repair.
  • Traveling on certain three-lane roadways under applicable lane rules.
  • Traveling on a roadway designated and posted for one-way traffic.
  • Driving at a reduced speed when necessary for safe operation or required by law.

Penalties

A violation of West Virginia's keep-right rule under §17C-7-1 is a misdemeanor.

A first conviction carries a fine of up to $100. A second conviction within one year carries a fine of up to $200, and a third or subsequent conviction carries a fine of up to $500.

The same general fine structure also applies to several related lane-use violations under Article 7.
