New Jersey Left Lane Law

New Jersey generally requires drivers on marked multi-lane roadways to use the lane nearest the right-hand edge or curb when that lane is available for travel, except when overtaking another vehicle or preparing for a left turn. The law also allows designated right lanes for slower traffic and prohibits drivers in designated inside lanes from unnecessarily slowing so as to block or hinder traffic.

New Jersey's primary lane-use rule is found in N.J.S.A. 39:4-88.

When a roadway has clearly marked traffic lanes, a vehicle normally must be driven in the lane nearest the right-hand edge or curb when that lane is available for travel.

A driver may use another lane when overtaking another vehicle or when preparing for a left turn.

New Jersey law also allows transportation authorities to designate right-hand lanes for slower-moving traffic and inside lanes for traffic moving at the designated speed. When those lanes are properly marked or signposted, a driver using an inside lane should not unnecessarily reduce speed in a way that blocks, hinders or retards traffic.

Drivers must also remain as nearly as practicable within a single lane and should not move from that lane until they have determined that the movement can be made safely.

New Jersey also restricts certain heavy trucks from using the farthest left-hand lane on qualifying multi-lane roadways, subject to statutory exceptions.

Exceptions

  • Overtaking and passing another vehicle traveling in the same direction.
  • Preparing for a lawful left turn.
  • Using another lane when traffic-control signs or lane designations lawfully permit it.
  • Situations where roadway configuration or emergency conditions require another lane position.

Penalties

New Jersey law provides a fine of not less than $100 and not more than $300 for failing to keep right under N.J.S.A. 39:4-82 or failing to observe traffic lanes under N.J.S.A. 39:4-88.

Additional surcharges, court costs or other assessments may also apply depending on the specific violation and circumstances.
