Maryland Left Lane Law

Maryland requires slower-moving vehicles to keep right in several situations. A driver traveling 10 mph or more below the applicable speed limit, or slower than the normal speed of traffic when conditions require lower speeds, generally must use the right-hand lane or stay as close as practicable to the right side of the roadway, except when passing or preparing for a lawful left turn. Maryland law also states that drivers traveling slower than the general speed of traffic should use the right-hand lane or lanes when practicable.

Maryland's keep-right rules are primarily found in Transportation Article §21-301.

Under Maryland law, a vehicle traveling 10 miles per hour or more below the applicable maximum speed limit generally must be driven in the right-hand lane then available for traffic, or as close as practicable to the right-hand curb or edge of the roadway. The same requirement applies when road or traffic conditions reasonably require speeds below the posted limit and the vehicle is traveling below the normal speed of traffic under those conditions.

This rule does not apply while the driver is overtaking and passing another vehicle traveling in the same direction or while preparing for a lawful left turn.

Maryland law also provides that a driver traveling slower than the general speed of traffic should, when practicable as determined by the driver, use the right-hand lane or lanes. However, the statute specifically states that this provision establishes state policy and guidance and that a driver may not be issued a citation solely for violating that particular provision.

For passing, Maryland generally requires a driver overtaking another vehicle in the same direction to pass on the left at a safe distance. Passing on the right is allowed only in specific situations and only when it can be done safely.

Exceptions

<ul>
<li>Overtaking and passing another vehicle traveling in the same direction.</li>
<li>Preparing for a lawful left turn.</li>
<li>Situations where roadway conditions, traffic controls, obstructions or lane configuration lawfully require a different position on the roadway.</li>
</ul>

Penalties

<p>Under the Maryland District Court's current Schedule of Preset Motor Vehicle Fines, failure to keep right while driving below the speed limit or normal speed of traffic under Transportation §21-301(b)(1) carries a preset fine of $90 and 1 point. The schedule lists a higher preset amount of $130 and 3 points when the violation contributes to an accident.</p>

<p>The separate provision advising drivers traveling slower than the general speed of traffic to use the right-hand lane is guidance only, and Maryland law specifically states that a citation may not be issued solely for violating that provision.</p>
