Does Virginia Require Drivers to Keep Right?
Yes. Virginia law generally requires vehicles to be driven on the right half of the highway when the roadway is wide enough, except in situations specifically allowed by law, including overtaking and passing another vehicle.
Do You Have to Move Right for a Vehicle That Is Passing?
Virginia law also requires the driver of an overtaken vehicle to give way to the right in favor of the overtaking vehicle, except when passing on the right is legally permitted. The overtaken driver may not increase speed until the passing vehicle has completely passed.
What About Commercial Vehicles?
Virginia has additional lane restrictions for certain commercial motor vehicles on interstate highways, including restrictions on use of the left-most lane under specified conditions.
Can You Pass on the Right?
Passing on the right is permitted only in certain situations and only when it can be done safely. Virginia law generally does not allow using the shoulder to make such a pass unless lawful signs specifically permit shoulder driving.
Exceptions
Virginia law recognizes exceptions to the general keep-right requirement, including overtaking and passing and situations where traveling on the right side is impracticable. Separate rules may apply to commercial vehicles, left exits, construction and other roadway conditions.
Penalties
A violation of Virginia Code § 46.2-802 is punishable by a $100 fine.
