Texas's primary keep-right rule is found in Transportation Code §545.051.
A vehicle traveling more slowly than the normal speed of other vehicles under the conditions then existing generally must be driven in the right-hand lane available for traffic, or as close as practicable to the right-hand curb or edge of the roadway.
This slower-traffic rule does not apply when the driver is overtaking and passing another vehicle or preparing for a left turn at an intersection or into a private road or driveway.
Texas also uses regulatory signs that state “Left Lane for Passing Only.” Transportation Code §544.011 governs this signage, and TxDOT policy requires these signs on highways with two or more lanes moving in the same direction when the posted speed is 75 mph or higher.
On roads where those signs are posted, the left lane is intended for passing rather than continuous travel. Drivers should move back to the right after safely completing a pass.
Texas also generally requires vehicles to stay on the right half of a roadway, subject to exceptions for passing, avoiding obstructions, certain three-lane roadways and one-way traffic.
Exceptions
- Overtaking and passing another vehicle traveling in the same direction.
- Preparing for a lawful left turn at an intersection or into a private road or driveway.
- Avoiding an obstruction when moving left is necessary and can be done safely.
- Traveling on a roadway divided into three marked lanes where another lane position is permitted.
- Traveling on a roadway restricted to one-way traffic.
- Following an official traffic-control device that lawfully directs traffic into another lane.
Penalties
Violations of Texas keep-right or passing-lane rules may result in a traffic citation. The exact fine can depend on the specific offense and the court handling the citation.
Texas transportation guidance has stated that impeding traffic by continuing to drive in the left lane where passing-only rules apply can result in a fine of up to $200.
