Georgia's keep-right rules are found primarily in O.C.G.A. §§40-6-40 and 40-6-184.
Under §40-6-40, a vehicle traveling at less than the normal speed of traffic under existing conditions generally must be driven in the right-hand lane available for traffic, or as close as practicable to the right-hand curb or edge of the roadway.
This slower-traffic rule does not apply when the driver is overtaking and passing another vehicle traveling in the same direction or when preparing for a left turn at an intersection or into a private road or driveway.
Georgia also has a specific passing-lane rule. On roads, streets or highways with two or more lanes allowing traffic to move in the same direction, a driver may not continue operating in the passing lane once the driver knows or reasonably should know that a vehicle traveling at a higher rate of speed is overtaking from the rear.
For this rule, the passing lane generally means the farthest left-hand lane, excluding a high-occupancy vehicle lane.
Georgia law also prohibits two vehicles from impeding the normal flow of traffic by traveling side by side in adjacent lanes, except where congestion causes vehicles to travel side by side.
Exceptions
- Overtaking and passing another vehicle traveling in the same direction.
- Preparing for a lawful left turn.
- Traffic congestion that makes use of the passing lane necessary.
- Inclement weather, obstructions or roadway hazards that make left-lane use necessary.
- Following a law or official traffic-control device that requires use of the passing lane.
- Using the passing lane when necessary to exit or turn left.
- Using the lane when necessary on a toll highway.
- Authorized emergency vehicles performing official duties.
- Vehicles engaged in highway maintenance or construction operations.
Penalties
Violations of Georgia's keep-right and passing-lane laws are traffic offenses. The exact fine and total amount due may depend on the court, the specific section charged and additional assessments.
Drivers should rely on the amount shown on the citation or verify the current amount with the court handling the case.
